Welcome to Hoodcast (“the App”), operated by Will Lisac (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.
1. Use of the App
Hoodcast is provided for personal, non-commercial use. You agree to use the App only in compliance with applicable local, state, and federal laws. You must not misuse the App or attempt to interfere with its normal operation.
2. No Professional Advice
Information provided through the App — including weather data, resort status, and road conditions — is for general informational purposes only and should not be relied upon for safety decisions or information. Always check official sources and follow posted signage, warnings, and advisories when driving or engaging in outdoor activities.
3. Third-Party Information
Some data within the App comes from third-party sources such as weather agencies, transportation departments, or ski resorts. We do not control or verify this information and make no guarantees about its accuracy, timeliness, or completeness.
4. Termination
We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for any reason, including violation of these Terms.
5. Disclaimer of Warranties and Limitation of Liability
THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND CONTENT AVAILABLE THROUGH HOODCAST ARE PROVIDED TO YOU “AS IS” AND WITHOUT WARRANTY.
WILL LISAC AND HIS AGENTS, CONTRACTORS, PARTNERS, AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES WITH REGARD TO SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND CONTENT, INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WILL LISAC AND HIS AGENTS, CONTRACTORS, PARTNERS, AND LICENSORS MAKE NO WARRANTY THAT:
(a) THE APP WILL MEET YOUR REQUIREMENTS;
(b) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
(c) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE;
(d) THE QUALITY OF ANY INFORMATION OR SERVICES OBTAINED THROUGH THE APP WILL MEET YOUR EXPECTATIONS; OR
(e) ANY ERRORS WILL BE CORRECTED.
YOU EXPRESSLY AGREE TO RELEASE WILL LISAC AND HIS AGENTS, CONTRACTORS, PARTNERS, AND LICENSORS (THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY CONNECTED WITH YOUR USE OF THE APP AND RELATED ACTIVITIES, AND PROMISE NOT TO SUE THE RELEASED PARTIES FOR ANY CLAIMS, ACTIONS, INJURIES, DAMAGES, OR LOSSES ASSOCIATED WITH YOUR USE.
YOU ALSO AGREE THAT IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH:
(a) YOUR USE OR MISUSE OF THE APP;
(b) YOUR DEALINGS WITH THIRD PARTY DATA SOURCES OR SERVICE PROVIDERS;
(c) ANY DELAY OR INABILITY TO USE THE APP; OR
(d) ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES, OR CONTENT OBTAINED THROUGH THE APP, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
6. Indemnification
You agree to indemnify, defend, and hold harmless Will Lisac and the Released Parties from and against any and all claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or in any way connected with your use of the App or violation of these Terms.
7. Changes to These Terms
We may update these Terms at any time. The latest version will be posted in the App or on our website. Continued use of the App after any changes means you accept the updated Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles.
